What Is the Foreclosure Process?
After you miss a mortgage payment, the loan company will begin to contact you through letters and possibly phone calls. If the wheels keep turning without payment, the foreclosure process can begin. In the state of Tennessee, you will generally experience a non-judicial foreclosure without involving a court. Instead of a day in court, the mortgage company needs to send you notices throughout the process with this type of foreclosure.
You will receive a notice twenty or more days before the house is to be sold. During the sale, the trustee will sell it at auction to the highest bidder. However, the lender also has the option to choose a judicial foreclosure in court, where the court makes the foreclosure decision. Altogether, the entire process for a non-judicial foreclosure that is not contested generally takes 90 to 120 days before it is complete. The process can take longer if you contest it or perform other actions, such as filing for bankruptcy.
What Are My Foreclosure Options?
